Protection of Minors: The SESF welcomes the new law, but urges for a fair implementation

The Swiss Esports Federation SESF acknowledges and welcomes the law’s goal for the protection of minors on film and video games (JSFVG), which seeks to protect minors from physical and psychological harm through inappropriate media content. The SESF supports the JSFVG in its current draft.

The approach taken with co-regulation is the most suitable approach to implement adequate protection of minors, which is both efficient and respectful to the industry. Furthermore, we would like to see consistent rules and regulations for the whole of Switzerland, which creates a transparent basis for all parties involved.

Important exception: participation in a tournament with the signature of legal guardian.

The SESF is happy with the possibility of tournaments and LANs organizers to allow underage participants to enter if they are given the written permission by a legal guardian (Art. 7b). This is a central element to the sustainable development of the Swiss Esports-Ecosystem. If the next generation of esports players cannot participate entirely in tournaments, they cannot be supported in their growth. Swiss esports would then be heavily disadvantaged in comparison to the international esports community.

The industry has already implemented a regulation concerning “participation only with signature” on their own accord. The new law would, therefore, only make the current regulation compulsory. The SESF supports the federal council’s consideration, which states that the exception is justified as the participants will have bought the game and played it at home for a substantial amount of time before participating in a tournament. There are already restrictions in place for buying games. Furthermore, it can be assumed that the playing of the specific game is allowed by the legal guardian.

Fair and pragmatic implementation

When implementing the law at the level of the ordinance, the federal council has to ensure that the further involvement of the esports industry is seen as compulsory for a composition of the youth protection organization to be representative of the involved industry and that the SESF will provide an appropriate representative.

The SESF is critical of the way the financial contribution of all stakeholders, whether directly involved in youth protection or not, is planned. On the one hand, it is understandable that the cost should be carried by all actors within their field. On the other hand, the amount must be in a reasonable proportion to the (financial) abilities of the specific actors. A fair solution has to be found in this.


Jugendschutz: SESF begrüsst das neue Gesetz, fordert aber eine faire Umsetzung

Der Schweizer Esports Verband SESF anerkennt und begrüsst das Ziel des Bundesgesetzes über Jugendschutz in den Bereichen Film und Videospiele (JSFVG), Kinder und Jugendliche vor physischen oder psychischen Schaden durch ungeeigneten Medieninhalte zu schützen. So wie aktuell vorliegend, unterstützt der SESF das neue Gesetz.

Der gewählte Ansatz der Ko-Regulierung ist die geeignetste Herangehensweise, einen wirksamen Jugendschutz wirkungsvoll und branchenverträglich umzusetzen. Weiter ist es wünschenswert, dass für die ganze Schweiz eine einheitliche Regelung gilt und somit eine klare Ausgangslage geschaffen wird.

Wichtige Ausnahme: Turnierteilnahme mit Unterschrift der Erziehungsberechtigten

Besonders begrüsst der SESF die Möglichkeit für Veranstalter von Turnieren und LANs, minderjährigen Teilnehmenden den Zutritt zu gewähren, wenn diese eine schriftliche Bestätigung der Erziehungsberechtigten vorlegen (Art. 7b). Dies ist ein zentrales Element für die nachhaltige Entwicklung des Schweizer Esports-Ökosystems, denn wo der Esports-Nachwuchs nicht vollumfänglich in Turnieren teilnehmen kann, wird kein Nachwuchs gefördert. Der Schweizer Esports wäre international abgehängt, bevor er überhaupt durchstarten konnte.

Bereits heute wird von der Branche die Regelung betreffend “Teilnahme nur mit Unterschrift” auf freiwilliger Basis umgesetzt. Das neue Gesetz würde somit die bestehende Praxis als allgemein verbindlich erklären. Der SESF stützt dabei die Überlegungen des Bundesrats, wonach diese Ausnahme dadurch gerechtfertigt ist, dass vor einer Turnierteilnahme das Spiel gekauft und vor allem auch länger zuhause gespielt wird. Da bestehen einerseits bereits Hürden zum Erwerb des Spiels und andererseits kann davon ausgegangen werden, dass die Eltern das Spielen des betreffenden Spiels erlauben.

Faire und pragmatische Umsetzung

Bei der Umsetzung des Gesetzes auf Verordnungsstufe muss der Bundesrat sicherstellen, dass der Einbezug des Bereich Esports als zwingend für eine repräsentative Zusammensetzung der Jugendschutzorganisation angesehen wird und der SESF die entsprechende Vertretung stellt.

Kritisch beurteilt der SESF weiter die Kostenbeteiligung aller Stakeholder, ob in der Jugendschutzorganisation direkt involviert oder nicht. Einerseits ist es nachvollziehbar, dass die Kosten von allen Akteuren im Rahmen ihres Bereichs getragen werden müssen. Andererseits muss die Höhe der anteiligen Kosten in einer vernünftigen Relation zu den (finanziellen) Möglichkeiten der einzelnen Akteure stehen. Hier muss eine faire Lösung angestrebt werden.
